Richard N. Schermer, a partner at Pathman Schermer Tandy, LLP, has practiced law for over 30 years. He is the leader of the firm’s real estate practice and its retail development group, a multi-disciplinary, collaborative team of attorneys. The firm’s real estate practice is highly sophisticated, handling a broad range of real estate acquisitions, development, financing, leasing and related matters and the retail development group specializes in all areas of industry specific retail development matters including acquisition, development, leasing, financing, land use and zoning, brokering, and enforcement of all retail development agreements for all forms of real estate offering a retail component.
Prior to joining the firm, Richard led the Florida real estate practice of a large national firm and chaired its National Retail Development Group. He represents developers, investors, lenders and users of commercial real estate (institutional, mid-size and entrepreneurial clients) in the acquisition, financing, development, leasing and sale of all types of real estate projects and developments across all asset classes.
Richard also specializes in the preparation of restrictive covenants and operating agreements for commercial developments and analysis of title to real estate. His practice includes restructuring and workouts of troubled financing related to these types of projects, representing lenders and owners throughout the process. He is an authorized agent and signatory for several national title insurance companies.
Richard delivers efficient, cost-effective and responsive service to clients in today’s highly competitive environment as a result of his extensive experience and thorough understanding of the commercial real estate business.
Richard has significant experience in sophisticated commercial transactions and particular expertise in the area of retail development and shopping center law. Having negotiated and drafted numerous purchase and sale agreements, financing and CMBS documents, leases (shopping centers, malls, street retail, build-to-suit leases, and ground leases) and reciprocal easement and operating agreements and site development agreements for some of the most prestigious shopping centers in the country, large grocery anchored centers, mixed-use projects and major single tenant projects, he has a deep knowledge of the acquisition, disposition, development and leasing issues, and provides clients entering into these types of transactions with an understanding of the standards and customs associated with obtaining maximum benefits and protections. At the same time, he remains sensitive to the nature of the marketplace and the need to continuously advance toward the closing of a deal.
Richard regularly lectures on commercial real estate topics including shopping center acquisition, development financing and leasing. He served for several years as a member of the Florida Program Planning Committee of the International Council of Shopping Centers (ICSC) and has chaired several ICSC programs for the Miami-Dade Chapter. He was also a member of the editorial board of the ICSC’s monthly publication, Retail Law Strategist.
Richard was selected by his peers for inclusion in the 2014-2022 editions of the Best Lawyers in America in the area of Real Estate Law and named among the Most Effective Lawyers by the Daily Business Review in 2005, due to his role as lead real estate counsel in several of the largest and most significant real estate transactions in Florida.
Richard is a 1982 cum laude graduate of Florida State University, where he majored in business management. He earned his Juris Doctor from the University of Florida in 1986.
